By using AreSimple’s products, software, or services (collectively, "AreSimple Services"), you agree to the following terms and conditions, and any policies, guidelines or amendments thereto that may be presented to you from time to time, including but not limited to Program Policies and Legal Notices (collectively, the "Terms"). We may update the Terms in the future, and you will be able to find the most current version of this agreement at http://www.aresimple.com/about/terms
Any personal information you supply to AreSimple when using AreSimple Services will be used by AreSimple only in accordance with its Privacy Policy: http://www.aresimple.com/about/privacy
All trade marks, copyrights, database rights and other intellectual property rights of any nature in AreSimple Services together with the underlying software code are owned either directly by AreSimple or by AreSimple’s licensors.
AreSimple hereby grants you a worldwide, non-exclusive, royalty-free revocable licence to use AreSimple Services for your personal use in accordance with these Terms.
You will not, nor will you allow third parties on your behalf to, (i) make and distribute copies of AreSimple Service software (“AreSimple Software”) (ii) attempt to copy, reproduce, alter, modify, reverse engineer, disassemble, decompile, transfer, exchange or translate AreSimple Software; or (iii) create derivative works of the AreSimple Software of any kind whatsoever.
Data and information provided and made available by AreSimple Services (“AreSimple Data”) is solely for personal use and may not be used for radio, newspaper, broadcast television, or cable television distribution. AreSimple Data may not be sold, leased, or sublicensed.
AreSimple Services are currently made available to you free of charge for your personal, non-commercial use. AreSimple reserves the right to amend or withdraw access to AreSimple Services or AreSimple Software, or require a charge for AreSimple Services provided to you in accordance with these Terms, at any time and for any reason.
AreSimple Services and AreSimple Data is not intended to be used in any application where human life or property may be at stake and AreSimple is not liable for any use of AreSimple Services or AreSimple Data that leads to death, personal injury, property or environmental damage.
You acknowledge that the terms of agreement with your respective mobile network provider (“Mobile Provider”) will continue to apply when using AreSimple Services. As a result, you may be charged by the Mobile Provider for access to network connection services used by AreSimple Services or any such third party charges as may arise. You accept responsibility for any such charges that arise.
If you are not the bill payer for the mobile telephone or handheld device being used to access AreSimple Services, you will be assumed to have received permission from the bill payer to access or use AreSimple Services.
AreSimple Services is available to handheld mobile devices running Android OS Operating Systems. AreSimple will use reasonable efforts to make AreSimple Services available at all times. However you acknowledge that AreSimple Services are provided over the internet and mobile networks and so the quality and availability of AreSimple Services may be affected by factors outside AreSimple’s reasonable control.
AreSimple and its sub-contractors do not accept any responsibility whatsoever for unavailability of AreSimple Services, or any difficulty or inability to download or access content or any other communication system failure which may result in the AreSimple Services being unavailable.
AreSimple will not be responsible for any support or maintenance for the AreSimple Services.
In order to use AreSimple Services, you are required to have a compatible mobile telephone or handheld device, internet access, and the necessary minimum specifications ("Software Requirements").
The Software Requirements are as follows: Android OS devices running Android OS 4.0.3 up to OS 5.0; Language: English.
The version of the AreSimple Services may be upgraded from time to time to add support for new functions and services.
AreSimple may terminate use of AreSimple Services at any time.
Upon any termination, (a) the rights and licenses granted to you herein shall terminate; (b) you must cease all use of AreSimple Services;
In no event will AreSimple be liable for any direct, indirect, special, punitive, exemplary or consequential losses or damages of whatsoever kind arising out of your use or access to AreSimple Services, including loss of profit or the like whether or not in the contemplation of the parties, whether based on breach of contract, tort (including negligence), product liability or otherwise.
AreSimple is not liable to you for any damage or alteration to your equipment including but not limited to computer equipment, handheld device or mobile telephones as a result of the installation or use of the AreSimple Software.
Nothing in these Terms shall exclude or limit AreSimple’s liability for death or personal injury caused by negligence or for fraud or fraudulent misrepresentation or any other liability which cannot be excluded or limited under applicable law.
To the maximum extent permitted by law, and for the avoidance of doubt, save for section 2 of the Supply of Goods and Services Act 1982, AreSimple hereby disclaims all implied warranties with regard to AreSimple Services. AreSimple Services are provided "as is" and "as available" without warranty of any kind.
